Chemical DUI Tests & Implied Consent Law in CA
If you failed a blood or breath test, it is still possible to demonstrate
that an error was committed in the results, either in how the test was
administered, sealed, or tested, etc. Chemical DUI tests have been proven
erroneous before. If you refused to even take a breath or blood test,
however, you will lose your driver’s license for one to three years,
even if you are acquitted of the DUI charges.
This is because of implied consent law: If you have a driver’s license,
you have implied your consent to take any chemical DUI tests requested
by an officer who pulls you over.
